A BILL to amend and reenact §61-8B-15 of the Code of West Virginia,
1931, as amended, relating to clarification of permissible
expenditures from the Forensic Medical Examination Fund.
Be it enacted by the Legislature of West Virginia:
That §61-8B-15 of the Code of West Virginia, 1931, as amended,
be amended and reenacted to read as follows:
ARTICLE 8B. SEXUAL OFFENSES.
§61-8B-15. Forensic medical examination fund; training of sexual
assault nurse examiners.
There is hereby created continued "The Forensic Medical
Examination Fund" created as a special fund in the State Treasury
into which shall be deposited the legislative appropriations made
to the fund. by the Legislature Expenditures from the fund shall
be made by The West Virginia Prosecuting Attorneys Institute, created by the provisions of section six, article four, chapter
seven of this code, shall make expenditures from the fund, where it
is determined to be practical by the executive council and the
executive director for the payment of to pay the costs of forensic
medical examinations as they are defined in section sixteen of this
article, to train nurses to examine sexual assault victims and for
the reimbursement to reimburse the institute of for its expenses in
administering the payment payments of the costs from the fund.
NOTE: This bill clarifies that the Prosecuting Attorneys
Association may expend money from the Forensic Medical Examination
Fund to pay to train nurses to examine victims of sexual assault.
